These Terms of Service govern your use of the website and services offered by Martens Media Group LLC., an LLC operating in Minnesota. By using our services, you agree to the terms below.

Services Provided

We offer:

  • DNS hosting and domain management
  • Website maintenance and support
  • Social media setup and content assistance
  • Search engine optimization and advertisement boosting
  • General digital services as agreed upon in written project terms

Each project or service may include a separate written agreement outlining services, details, timelines, and pricing.

User Responsibilities

By using our website or services, you agree to:

  • Provide accurate and lawful information
  • Ensure that any content you supply does not infringe on the rights of others
  • Maintain the confidentiality of account or login credentials when applicable
  • Comply with all local, state, and federal laws

Clients are responsible for the content they host, publish, or request us to manage.

Intellectual Property

Unless stated otherwise in writing:

  • You retain ownership of all original content you provide
  • The Company retains ownership of custom code, templates, or proprietary tools created during development until full payment is received
  • After payment, ownership may transfer to you as specified in the project agreement
  • You may not copy, redistribute, or resell our work without permission
  • Depending on the specific agreement, posted payment dates can vary between: bi-weekly, the 1st or 15th of the month, or a full one-time payment.

Payments and Refunds

Payment terms are defined in each individual project agreement. Deposits may be required.
Refunds are assessed based on work completed up to the cancellation date.

Recurring services such as hosting or DNS fees may be billed monthly or annually.

DNS Hosting and Website Hosting Terms

If you use our DNS or hosting services:

  • We cannot guarantee continuous uptime
  • We are not responsible for downtime caused by third party providers or internet outages
  • You agree to maintain secure passwords and follow recommended security practices
  • We may suspend hosting services for misuse, illegal activity, or non payment at any given time

Social Media Services

For social media support:

  • You must provide lawful content and access credentials when needed
  • We are not responsible for actions taken by third party platforms
  • We do not guarantee account growth or performance results

In-person Technology Services

For managing your bulk tech via Workspace, 365, or ABM:

  • It is fully up to Martens Media Group to decide where in-person services can be provided.
  • Martens Media Group reserves the right to refuse in-person service regardless of “closeness”, “location”, or any other “real-world” scenarios.
  • Martens Media Group also reserves the right to stop services at any time, regardless of the reasoning. Examples include but are not limited to: location changes, technology fluctuations, pricing disagreements, and/or convenience whether for the provider or consumer.

Limitations of Liability

Martens Media Group is not liable for:

  • Service interruptions
  • Data loss
  • Third party service failures
  • Security incidents beyond our reasonable control
  • Client misuse of services or published content
  • Termination of services due to location changes

Our total liability for any claim is limited to the amount paid for the specific service.

Termination

We may terminate or suspend services if a user violates these terms, engages in harmful activity, or fails to make payment.
You may terminate services by notifying us according to your project agreement. We can not guarantee refunds for the currently serviced month.

Changes to These Terms

We may modify these Terms of Service at any time. Continued use of the website or services indicates acceptance of any revised terms.
